Which would suggest he didn't have a current WILL at that time.  So how can Branca/McLain say they have a will from 2002???

Interesting, I don't recall hearing this before.  The thing about Michael is nobody really knows anything about him, there's so much conflicting information out there...and I'm sure that's how he wants it.

Guys, I am going to let you in on a little secret.  That address does not exist for Bank of America in New York.  Believe me I know Trust me on this one.  Bank of America does not have a location at that address. I do not know who Mr. Malnik is trying to fool.

I think Malnic was/is as shifty and two faced as they get. He was in bed with matolla, while working both sides of the game. His mafia ties have been verified by others and he was named the heir apparent to Meyer Lansky.
So a mob accountant. a money launderer. Doesn't the story go that MJ was snooping around late and overheard Al on the phone with Matolla and he packed his bags and gathered his  children and left first thing in the morning. With friends like that who needs enemies.

Is it possible that it had such a location in 2004?

VeryLittleSusie,  There never was a Bank of America at that address. Let me share with you with some information.  Bank of America bought Merrill Lynch. There is a Merrill Lynch branch at 717 Fifth Avenue , NY, NY  not 767 Fifth Avenue  12th Floor. That is a residental building. How do I know that. Mainly because I live in New York city, Manhattan and I work around that area. And you just don't close down a branch like that in the Financial Industry and it not be on the news.

A bit of history

Mafia connected to the Muzik Industry

Meyer Lansky

Meyer Lansky (born Majer Suchowliński, July 4, 1902 – January 15, 1983) was a gangster who, with Charles Luciano, was instrumental in the development of The Commission (and possibly the “National Crime Syndicate“) in the United States. Lansky also headed up Murder, Inc. for The Commission and was largely responsible for the Mafia’s development of Las Vegas and a financially beneficial relationship with the corrupt Cuban regime of Fulgencio Batista y Zaldívar. Although Jewish (Jewish mafia), Lansky undoubtedly played a central role in the Italian Mafia‘s organization and consolidation of the criminal underworld (although the full extent of this role has come under some debate).

Meyer Lansky was born in Grodno, Russia (now Hrodna, Belarus) to Max Suchowlijanski and his wife Yetta Lansky. In 1911 the family emigrated to the United States and settled on the Lower East Side of Manhattan, New York. While Lansky was in school, he allegedly met young Charles “Lucky” Luciano, who tried to shake him down (extort money). When Lansky refused to pay, Luciano was impressed with the younger boy’s bravery and the two became friends for life. Lansky met Bugsy Siegel when he was a teenager. They also became lifelong friends, and together with Luciano, formed a lasting partnership. Lansky was instrumental in Luciano’s rise to power by organizing the 1931 murder of Mafia powerhouse Salvatore Maranzano. As a youngster, Siegel saved Lansky’s life several times, a fact which Lansky always appreciated. The two adroitly managed the Bug and Meyer Mob despite its reputation as one of the most violent Prohibition gangs. Lansky was the brother of Jacob “Jake” Lansky, who in 1959 was the manager of the Nacional Hotel in Havana, Cuba.
By 1936, Lansky had established gambling operations in Florida, New Orleans, and Cuba. This was the same year that his partner Luciano was sent to prison. As Alfred McCoy records: “During the 1930s, Meyer Lansky ‘discovered’ the Caribbean for northeastern syndicate bosses and invested their illegal profits in an assortment of lucrative gambling ventures… He was also reportedly responsible for organized crime’s decision to declare Miami a ‘free city’ (i.e., not subject to the usual rules of territorial monopoly).” Later, Lansky convinced the Mafia to place Siegel in charge of Las Vegas, and became a big investor in Siegel’s Flamingo Hotel project. After Al Capone‘s 1931 conviction for tax evasion & prostitution, Lansky realized his own vulnerability to this type of prosecution. In response, he transferred illegal funds from his growing casino empire to Europe, where he opened a numbered bank account following the 1934 Swiss Banking Act. Later, according to Lucy Komisar, Lansky would even buy an offshore bank in Switzerland, which he used for money laundering through a network of shell and holding companies.
A close associate of Lucky Luciano who would attend Mafia conventions with the head of the Luciano crime family, Lansky would not sit in on Mafia discussions.
In the 1930s, Meyer Lansky and his gang stepped outside their usual criminal activities to break up rallies held by Nazi sympathizers. Lansky recalled a particular rally in Yorkville, a German neighborhood in Manhattan, that he and 14 other hoods disrupted: The stage was decorated with a swastika and a picture of Hitler. The speakers started ranting. There were only fifteen of us, but we went into action. We threw some of them out the windows. Most of the Nazis panicked and ran out. We chased them and beat them up. We wanted to show them that Jews would not always sit back and accept insults.

The Flamingo soon went back into the red. At a third meeting, the family decided that Siegel was finished. He had humiliated the organized crime bosses and never had a chance. It is widely believed that Meyer Lansky himself was compelled to give the final okay on eliminating Siegel due to his long relationship with Siegel and his stature in the family.

This also marked a power transfer in Vegas from the New York to the Chicago crime families. Although his role was considerably more restrained than in previous years, Lansky is believed to have both advised and aided Chicago boss Tony Accardo in initially establishing his hold.

However, the 1959 Cuban revolution and the rise of Fidel Castro changed the climate for mob investment in Cuba. The new Cuban president, Manuel Urrutia Lleó closed the casinos and nationalized all the casino and hotel properties. This action essentially wiped out Lansky’s asset base and revenue streams. Lansky left Cuba for the Bahamas and other Caribbean destinations. With the additional crackdown on casinos in Miami, Lansky was forced to depend on his Las Vegas revenues.

Lansky invariably kept very little property in his name throughout his career, concealing his equity through partnerships, and appeared to be just another struggling old man. Among Lansky’s frontmen were men like Sam Cohen, Ben Siegel and Alvin Ira Malnik. Malnik had originally started working for Lansky associate Al Mones in the late 1950s. Malnik’s rise in the Lansky organization was fast and by 1970, he had seemingly become the most valuable player. After Lansky’s death in 1983, Alvin Malnik’s power became more visible than ever. Law enforcement officials have long suspected him to be Lansky’s sole “heir”. During the 1970s, Lansky fled to Herzliya Pituah, Israel, to escape federal tax evasion charges. Two years later, Israel deported Lansky back to the U.S. However, the government’s best shot at convicting Lansky was with the testimony of loan shark Vincent “Fat Vinnie” Teresa, an informant with little or no credibility. The jury was unreceptive, and Lansky was acquitted in 1974.

However, his biographer Robert Lacey describes Lansky’s financially strained circumstances in the last two decades of his life and his inability to pay for health care for his relatives. For Lacey, there was no evidence “to sustain the notion of Lansky as king of all evil, the brains, the secret mover, the inspirer and controller of American organized crime.” He concludes from evidence including interviews with the surviving members of the family that Lansky’s wealth and influence had been grossly exaggerated, and that it would be more accurate to think of him as an accountant for gangsters rather than a gangster himself.

The Music Industry And The Mafia

There are some individuals in the music industry that have long had ties with the mafia. It earned some them a bad reputation that they were never able to shake. For years many have claimed Motown was started with mob money. Motown founder Berry Gordy vehemently denies the allegation to this day. For years Frank Sinatra was accused of working for the mob. He never denied it nor did he confirm it.

Tommy Mottola, the former head of Sony Music, and ex-husband of singer Mariah Carey, was the subject of a widely read, unflattering piece in Vanity Fair that flat out said he has mob ties.

The news also brought a quick call to Sony from a CBS corporate officer. ”Do you know this guy has a Mafia background?” a senior executive quotes the CBS man as saying. “What are you doing tainting this wonderful company you just bought from us with a guy who has a background that could make the F.B.I cringe?” – Vanity Fair

Then there was former Miami club king Chris Paciello, who dated Madonna, and was indicted, convicted and sent to prison for 10 years on a mafia related murder that transpired in his home state of New York. Madonna’s girlfriend, literally, Ingrid Caseres, reportedly even accompanied him to mob meetings, according to Gangland News.

Madonna Ciccone, her daughter and mafioso Chris Paciello in Miami in the 1990′s

Paciello became a prominent figure on the club scene in Miami in the 90′s, making millions from two night clubs and a restaurant. Then came the indictment against him for a mob murder in New York. Gone was his money and fame to federal indictments, lawyer fees and jail. He snitched on the mob and received 7 years in jail.

Then there’s the Anthony Pellicano wiretap, harassment and witness tampering scandal where writer Anita Busch was targeted:

“Los Angeles Times writer Anita Busch has been looking into the federal indictment of reputed Mafia captain Anthony (Sonny) Ciccone on charges of extortion and threatening to kill actor Steven Seagal.” – Los Angeles Times 7/12/02

There’s that name again “Ciccone.” Fancy that, Madonna’s faking an English accent, trying to break into the English aristocracy, when she’s got more mob ties than Capone. Because tea, Ascot and the English countryside go hand in hand with the mafia. Not. Madonna puts the c in common.

Anthony Pellicano worked for clients such as Madonna and Tom Cruise. The federal government stated this year that Pellicano has mob ties and tried to put a hit on an incarcerated man that worked with him, to stop him from testifying in the disgraceful wiretap scandal that has exposed several Hollywood stars and just how far they will go.

But at the end of the day, one really has to asks oneself, what does music or film have to do with crime. As a star, to venture into such territory tells the world you shouldn’t even be in the business at all.

Michael Jackson & Al Malnik, Mafia Successor to Meyer Lansky

St. Louis connection to Michael Jackson: Attorney Alvin Malnik
By Deb Peterson
St. Louis Post-Dispatch

TWO DEGREES OF SEPARATION: South Florida kingpin and St. Louis native, Alvin I. Malnik, 76, has been getting a lot of face time since Michael Jackson’s death. Malnik — a product of Clark Elementary School, Soldan High and Wash U. — was a friend of Jackson’s for a long time and says the King of Pop asked him to become godfather and parent to Prince Michael II, “Blanket” if anything happened to Jackson.

Malnik has been interviewed about his connections to Jackson by NBC’s Today Show, CBS and the Palm Beach Post, among others. Malnik is an attorney who had close ties to mobster Meyer Lansky and was at one time considered Lansky’s “heir apparent.”

Malnik has said he signed a document in 2003 saying that he could take custody of Blanket if anything happened to Jackson and that he also agreed in writing to be the executor of Jackson’s estate. Malnik says that Jackson at the time became the godfather of Malnik’s then 11-year-old daughter, Spencer. Jackson and Malnik reportedly had a falling out in the past couple of years. The cause of the estrangement is unclear.

Jackson used to seek refuge in Malnik’s 15-bedroom, 35,000-square-foot Palm Beach County mansion in Ocean Ridge. He reportedly would stay there for months at a time with his children and an entourage. Malnik was Jackson’s attorney and said he helped him refinance his debt with Sony and the Bank of America. Malnik also was the owner of the exclusive Forge restaurant in Miami, which he sold to his son Shareef.

Jackson sat with Malnik at the head table during Malnik’s 70th birthday bash at the Forge in 2003, which was attended by my predecessor at the Post-Dispatch, Jerry Berger. Berger was a longtime friend of Malnik’s. He
wrote about the party that “the invitation to Florida itself was unique: a taped message from the King of Pop himself, Michael Jackson. But the event lived up to its billing. Jackson, accompanied by a full phalanx of bodyguards, was on hand to welcome Malnik’s guests, including B.B. King, Smokey Robinson, F. Lee Bailey and celeb lawyer Roy Black.”

Berger included the names of some of Malnik’s St. Louis pals who were at the shindig: Attorney Martin Green, merger and acquisitions mogul Gilbert Kopolow and L.A.-based sales exec Barry Gelber. He said the Harbour Group’s Sam Fox and his wife, Marilyn, friends of Malnik’s since high school days, were no-shows but were represented by a magnificent floral masterpiece from the Fox den.

Malnik also turned up with a connection to St. Louis County Executive Charlie Dooley. His name was on a list of campaign contributors as having donated $2000 to Dooley’s unsuccessful campaign for Congress in 2000; Dooley was
a St. Louis County councilman at the time.
