I can't say that I'm a fan of these delays. Hopefully this trial is another fake like Murray's and it never happens. Hope MJ BAMS before April 02 2013.

I don't think this trial will happen, I don't think it's real. I think it's a lot of talk n hearsay contrived in the background for the hoax. I think it provides a good excuse for KJ and the Family to be tight-lipped about certain things they don't want to/can't discuss (example, KJ's CNN interview) while simultaneously providing a reason for MJ news to keep hitting the airwaves. I think it needed to be "delayed" to put it so far off in the future that it comes post-bamsday and will never occur.

Perhaps wishful thinking. I can't put my life on hold for another year.

A Park Avenue doctor who examined Michael Jackson months before his death is facing a court challenge from an entertainment firm that wants details about the checkup.
Lawyers for AEG Live — the firm that was producing Jackson’s ill-fated comeback tour — have asked a Manhattan Supreme Court judge to order Dr. David Slavit to comply with a subpoena issued in California.
AEG was hit with a wrongful death suit from the Gloved One’s family, who say the promoters should have known he was too sick for the stage.
AEG’s lawyers say Slavit’s February 2009 examination of Jackson is essential to their defense because it enabled the firm to get insurance for the concert series, which was supposed to start in London in July 2009. Jackson died of an overdose in June 2009.

AEG’s lawyers contend they have been trying for a year to get Slavit to sit for a deposition and share medical records from the exam. They say he canceled the first time they set a date for a deposition, court papers say, and that Slavit and his father, Leonard Slavit, a negligence attorney, have since put up a series of obstacles to establishing a new date.
“Despite repeated and tireless efforts to resolve the matter without court intervention, AEG has no choice” but to ask the courts to order Slavit to cooperate, the AEG lawyers argued in court papers.
Neither Slavit nor his father could be reached for comment.
Jackson’s personal doctor, Conrad Murray, who provided the medication on which he overdosed, was convicted of involuntary manslaughter in 2011. He is currently serving a four-year prison sentence.

kind of off topic:  the other day my hubby was showing me an article ( and having a bit of a laugh) at these celebrity have insured their legs , noses and of course boobs.

this left me wondering why in the world michael would not have had something like this being he obviously had some things ( his dancing and vocal abilities) that some of these don't really have.

it just made me wonder, sorry for the distraction.  :-[

So it's under a fake name, and why a ear-nose-throat specialist? When MJ's supposed problems were insomnia, drugs, weakness, etc.

He can’t produce records on Michael Jackson because he has none.  Didn’t AEG ask for this previously and never received it?  There is no way a policy can be issued in an assumed name and be legitimate.

Why would an ear, nose and throat specialist be hired to do a complete physical examination required to underwrite millions of dollars of performance insurance, and then use an assumed name.  Heaven forbid anything should go wrong and the insurance be required to pay out. Nobody would be paid unless of course they could prove that Michael Jackson was the Mark Jones named on the certificate… which of course would be an admission of fraud. Robertson Taylor (AEG’s attorneys) had the same concerns or so they claim.  But if they had issues with the expertise of the doctor chosen to do the physical, why did they not insist on another doctor before going forward? It doesn’t make sense to me.

It all depends on who the specific insurance company is.  Some may have provisions included in their policy for the insured person to use a specific doctor only.
Others may not.  But it is not common practice to use an ear, nose and throat specialist to do a complete physical on an insured as hes already mentioned in her post.

i can see ear nose and throat specialist being involved , but under the strenuous physical circumstances there would need to be more.  interesting points about tii though we have instances of talking about using the earbuds and we have him talking about conserving his voice. and of course there is always constant focus on that nose from everyone.  :icon_lol:

and we are talking about lords of lundon here i don't think you insure your average joe  :icon_e_wink:

LOS ANGELES (AP) - A jury should decide whether the promoter of Michael Jackson's final concerts negligently hired and supervised the physician convicted of causing the singer's death, a judge tentatively ruled Monday.

If the ruling stands, it will allow the case by Jackson's mother, Katherine, to go forward and present the theory that concert giant AEG Live controlled the physician who gave the superstar a lethal dose of the anesthetic propofol.

Superior Court Judge Yvette Palazuelos' tentative ruling however eliminates some of Katherine Jackson's claims and an attorney for AEG predicted the company would win at trial.

It is unclear when the ruling will be finalized, or whether the judge will change it. She heard two hours of arguments about the case on Monday but didn't indicate whether her mind had been changed.

AEG attorney Marvin Putnam said he was pleased with the ruling and reiterated his belief that the case should have never been filed.

The case centers on whether AEG did an appropriate investigation of Conrad Murray, a former cardiologist who is serving his sentence after being convicted of the involuntary manslaughter of the pop singer. The case also involves whether AEG controlled him while Jackson prepared for a series of comeback concerts.

Katherine Jackson's attorney, Kevin Boyle, declined comment after the hearing, saying he wanted to see the final order.

He told Palazuelos that AEG created a division of loyalties for Murray between his care of Jackson and maintaining an arrangement that would have paid him $150,000 a month to care for the singer.

Jackson died before Murray's contract was signed, and AEG argues he was not an employee of the company.

"AEG just made this more risky for Michael," Boyle argued Monday.

He said the case was unique and it should proceed intact with claims that AEG is liable for Murray's actions. "This has never happened before, or at least no one's been caught," Boyle said.

Putnam argued that by the time it was negotiating Murray's contract to treat Jackson while performing a series of London concerts, the doctor had already been treating the singer for some time, had relocated from Las Vegas to Los Angeles and had ordered large amounts of propofol to help Jackson sleep.

"Sadly, it appears that Michael Jackson's death would have occurred anyway," Putnam said after the hearing.

Katherine Jackson sued in September 2010 and a trial has been scheduled for early April.

That caught my attention as well, a rather presumptuous statement that left the article hanging...


On another note, I wonder if "Exhibit B gonna rock that trial" as Front predicted.  This trial, on the surface, is about AEG being negligent about Murray but I imagine a lot more will be revealed. 

What I'm wondering is - if it comes out that AEG hoped to essentially de-fraud Michael by taking everything he had (Exhibit B of Michael's contract/letter of intent with AEG) if MJ failed to perform all the shows - will AEG be held responsible for that? Because that's not what the trial is about, it's supposedly about Murray. Is this a way to "protect" AEG from being liable for their part in trying to steal from Michael?  But the damage will still be done because it will come out, everyone will know what they tried to do.  I'm not sure how that works though, if a unrelated revelation is made during a trial that's about something else, can AEG be re-tried?  Or is there a law that protects a defendant somehow?  And is what they did in the contract technically illegal or not? I really don't know.  And what if someone(s) else is implicated in the trial?  Ah, maybe I'm getting ahead of myself here.  I just don't know if AEG is going into this trial blind and oblivious to the hoax or not.
