Dr. Conrad Murray's lawyers are split over whether the doc should take the stand in his own defense ... TMZ has learned.

Sources connected with the case tell TMZ Ed Chernoff is adamant -- he does NOT want Murray to testify because he would be crucified on cross-examination.

Michael Flanagan feels the opposite -- that Murray MUST take the stand because without his testimony the jury will convict him.

We're told Murray will defer to his lawyers, but Murray and Chernoff are joined at the hip and it's almost certain the doc will follow his lead.  Besides, Chernoff is the lead counsel and when push comes to shove -- he wins.

Our 2 cents -- Murray testifying would be a disaster for the defense.

Toldja so!  Dr. Conrad Murray will not take the stand ... the defense just confirmed.

As we previously reported, there was a split between Murray's lawyers Ed Chernoff and J. Michael Flanagan over whether Murray should testify.

Chernoff believed Murray would have gotten crushed in cross-examination -- but Flanagan didn't think Murray could win over the jury without giving his side of the story.

After the dust settled, Chernoff prevailed. So Murray will keep his mouth shut.

The day after Conrad Murray's defense team rested their case in his manslaughter trial, the doc enjoyed a day at the beach with his girlfriend Nicole Alvarez and their son in Santa Monica on Wednesday.

Closing arguments are scheduled to begin this morning -- and some experts believe there is a good chance the jury could return a verdict by the end of the week.

This is how he rolls ... his jeans.

Last night, Conrad went to Gladstones in Malibu with some of his former patients for a fancy pre-closing arguments dinner.

We asked Murray if he regrets not testifying on his behalf ...  but it was obvious what his biggest regret was ... no leftovers wrapped in those awesome tinfoil swans.

Dr. Conrad Murray's defense attorney, Ed Chernoff, came out firing at the prosecution in his closing statement ... telling the jury, "They want you to convict Dr. Murray for the actions of Michael Jackson ... they just don't want to tell you that."

Chernoff was direct, "Dr. Murray did NOT kill Michael Jackson" ... claiming it was Michael Jackson who killed Michael Jackson by self administering himself with prescription medication. 

Chernoff claims the prosecution failed to prove that Murray hooked MJ up to a Propofol drip before the singer died ... and without a drip, there is no way the prosecution can prove Murray ever put MJ's life in danger.

"They can't prove a crime ... and they REALLY need to prove a crime" ... Chernoff said.

Chernoff claims the most logical explanation is ... "Michael Jackson went into his personal bathroom and swallowed Lorazepam and Dr. Murray didn't know."

He added, "Somebody's got to say it ... If it were anybody else but Michael Jackson ... anybody else, would this doctor be here today?"

Chernoff might be feeling the the heat ... he just drank a glass of water and quipped, "Is it warm in here or is it just me?"

He concluded by asking the jury to take their decision seriously ... saying, "This is not a reality show, this is reality ... I hope that you do the right thing and find Dr. Murray not guilty."

Prosecutor David Walgren is attacking with sarcasm in his closing statement rebuttal ... telling the jury, "Poor Conrad Murray ... everyone is just working against him."

Walgren says Dr. Murray's treatment of Michael Jackson was littered with, "bizarre, unethical, unconscionable behavior" ... adding, "That is why we are here."

Walgren says the defense team is blaming EVERYONE but the doc -- mocking the defense for suggesting a "conspiracy" against the doctor.

"Everyone's to blame but Conrad Murray ... poor Conrad Murray."

Dr. Conrad Murray is "optimistic" about his chances for acquittal ... this according to people close to the doc.

Murray spent last night at home, with his baby mama Nicole Alvarez and their child. Murray says he has faith the jury will not come to the conclusion he caused Michael Jackson's death.

Murray has been the poster child for projecting innocence during a criminal trial, frequently seen strolling in Santa Monica and appearing carefree.  Two nights ago, he went to a popular Malibu restaurant with some of his patients.

The Jackson family is NOT inside the courtroom this morning ... as they have been for most of the Conrad Murray manslaughter trial ... but sources tell TMZ -- they WILL be when the verdict is read.

Sources close to the family tell TMZ ... the family is expected to get a 2-hour heads up when the jury is ready to present their verdict to the judge ... at which point, Katherine, Jermaine, La Toya and the rest of the crew will head on down to the courthouse.

The jury has already begun deliberating -- and they could return a verdict at any moment.

Misery loves company -- Dr. Conrad Murray says he won't be spending what could be his final days of freedom alone.

While the jury deliberates the doc was spotted walking in Santa Monica ...and claimed he'll be hunkering down with "friends and family, and my children."

As TMZ first reported, Murray is "optimistic" the jury will acquit -- but, he claims, he ultimately has "no idea" how they'll swing.

With the fate of Conrad Murray still hanging in the balance, Michael Jackson's children -- Prince, Blanket and Paris (in the white hat) -- went to the movies last night and saw "Tower Heist."

According to our sources, Katherine has been filling the children in on the details of the trial herself -- she'd rather they hear it from her and not through anyone else.

We're told when the verdict comes down, Katherine will be the one to tell them the news.

Jurors did not reach a verdict on Friday and deliberations will continue Monday morning.

Conrad Murray is leaving no stone unturned ... he went to church in L.A. last night.

Murray and his girlfriend/baby mama, Nicole Alvarez, went to the West Angeles Church of God in Christ in the Crenshaw district.

On his way out of the service, Murray told a photog, "God is good."

We're told Murray, a deeply religious man, prays all the time, but he's "optimistic" he'll be found not guilty.

Time will tell ...

Michael Jackson's parents -- along with La Toya, Jermaine and Randy -- are currently scrambling to get to the L.A. County Courthouse after they were notified the jury had reached a verdict in the Conrad Murray manslaughter case.

The entire crew is traveling from Calabasas, which -- if traffic is good -- can take somewhere between 45 mins to an hour. 

We're told the family is "anxious."

MJ's kids are staying at home with other family members. We're told they were instructed NOT to watch the verdict live -- so Katherine could break the news herself when she got home.

The man of the hour -- Prosecutor David Walgren -- who won the Conrad Murray case, might as well have been sent to Siberia by his boss, L.A. County District Attorney Steve Cooley, because he was completely out of the shot as Cooley took credit for the victory.

It's pretty stunning, given that the winning prosecutor typically addresses the media after a verdict, but even if the D.A. was exercising caution while the sentence is pending, Cooley didn't even allow Walgren to stand next to him.

Instead of Walgren, Cooley was flanked by his number 2, Jackie Lacey, and D.A. honcho Pat Dixon. Choosing Lacey is an audacious move on Cooley's part, since he personally chose her to run as his successor in the 2012 election. 

A D.A. spokesperson said Lacey was standing next to Cooley because, "It's like Captain Kirk and Mr. Spock."

Dr. Conrad Murray has been found GUILTY of involuntary manslaughter in the death of Michael Jackson.

After the verdict was read, you can hear La Toya Jackson and Kathy Hilton cry.

Jurors came back with the verdict moments ago after a grueling 6-week trial, finding prosecutors proved beyond a reasonable doubt ... Dr. Murray is responsible for MJ's death.

Murray faces up to 4 years behind bars, but the reality is ... he will not go to state prison because of a new law, and will likely serve his time in L.A. County Jail.

Murray is scheduled for sentencing on November 29th.

Law enforcement tells TMZ ... Dr. Conrad Murray has been deemed a "keep away inmate" -- which means jail officials will be taking special precautions to keep him safe during his stint behind bars.

We're told Murray will be assigned a single cell for his own protection -- and he'll also be assigned an "escort" to keep an eye on the doc wherever he goes inside the jail ... including shower time.

Officials tell us Murray will not be allowed to mingle with the general inmate population -- which is a blessing and a curse for Murray ... who will surely feel safer, but also INCREDIBLY lonely at the same time.

Dr. Conrad Murray was just handcuffed in court ... after the judge remanded him into custody.

Murray is being held without bail until his sentencing on November 29th.

Law enforcement sources tell TMZ, the doc will get his own cell in L.A. County jail -- as well as an escort whenever they decide to move him.

The LAPD couldn't be happier with today's guilty verdict in the Conrad Murray manslaughter trial -- telling TMZ, the verdict represents a "victory " in the eyes of law enforcement.

A rep for the LAPD issued the statement -- claiming, the department "applauded" the jury's verdict.

According to the rep, "Today's verdict of guilty is confirmation that the combined efforts of our investigators, criminalists, Coroner investigators and the District Attorney's Office were sound."

The rep adds, "The investigators have worked diligently on this case and were confident throughout the process that the investigation supported the allegation of involuntary manslaughter."

He's barely been locked up a couple hours -- but TMZ has learned, Dr. Conrad Murray has already been offered a delicious sacked lunch behind bars ... including jailhouse-baked cookies.

Law enforcement sources tell TMZ, Murray's first meal contained a cheese sandwich, some fruit punch, a few carrot sticks, and some homemade Oreo-knockoff cookies ... baked in the jail's own bakery.

No word on whether Murray actually ate any of it, but we're guessing he didn't have much of an appetite.

TMZ has obtained an excerpt of a never-before-seen documentary starring Dr. Conrad Murray -- in which the good doc reveals some very intimate details about the singer ... some of which are not flattering.

The documentary -- titled, "Michael Jackson and The Doctor: A Fatal Friendship" -- was shot while Murray awaited trial for manslaughter ... and features a shockingly candid look at the preparation of the trial, which includes intense fighting between Murray's lawyers.

The movie is being distributed by a company called Zodiak Rights ... which says it's already pre-sold the rights to air the documentary to "major broadcasters around the world."

Sources tell TMZ ... NBC is one of the broadcasters ... and will air the doc in the United States. 

As for Dr. Murray -- he signed on to the project back in 2009, following MJ's death. It's unclear how much cash Murray is set to make from the movie.

Dr. Conrad Murray is currently being held in the medical ward at the L.A. County Men's Central Jail -- but it's NOT because there's anything wrong with him ... TMZ has learned.

Law enforcement tells us ... Murray has been assigned to the medical ward while he's being processed -- as opposed to the regular holding area.

We're told the medical ward has a "higher density of deputies" -- which means it's easier for officers to keep an eye on a high profile prisoner like Murray when he's in the M.W.

As we previously reported, Murray has been deemed a "keep away prisoner" -- which means officials must keep an eye on the doc at all times, as a matter of his own protection.

There are several reports that Murray is on suicide watch -- but officials at the jail tell us those reports are incorrect.

Kurt Loder -- the longtime face of "MTV News" -- says he believes Michael Jackson was a child molester.

Loder appeared on the "Jeff and Jeremy in the Morning" radio show this morning  ... when he was asked if he thought MJ's death was a tragedy.

Loder replied, "Its a shame how he grew up ... his childhood was a shame ... there is many sad aspects to his life, ... on the other hand, I think he was a child molester, and that sort of tempers any feelings you might have about him."

When asked why he believed MJ molested kids, Loder claimed he knew about secret payouts to the parents of little boys ... and pointed to MJ's bizarre behavior.

"Having sleepovers with little boys, and you're a 40 year old man??? Uh, NO. You're like a child molester."

Loder continues, "Maybe being a child molester is the product of a pretty terrible childhood he had ... you can see why that might have happened. On the other hand, molesting children is bad."

A juror in the Conrad Murray trial tells TMZ ... the decision to find Murray guilty of involuntary manslaughter was not difficult, and jurors were all in agreement early on in the deliberation process.

The juror -- who asked not to be identified -- tells us jurors were not conflicted and that "it was a concrete decision." 

The juror also said the jurors were unified early on ... long before they ended their 8-plus hours of deliberations.

As for what swayed the jury, the juror did not want to speak for the others but said it was the totality of the evidence.  We asked if Murray's 2-hour interview with LAPD detectives was a turning point, but the juror said it wasn't.   The juror said the body of evidence -- not one individual item -- was just overwhelming.

The juror is "glad it's over" and is happy to return to "normal life."

File this under creepy -- You can wake up in the same spot where Michael Jackson didn't ... because his death bed is officially hitting the auction block.

The queen-size bed is just one of the many items from the Holmby Hills home where MJ died that will be included in a Julien's Auctions event next month.

We're told the bed is still in good shape -- but linens have been changed, since MJ's death.

Other items included in the auction are a mirror from Jackson's "inner sanctum -- a private bedroom in the home where NO ONE else was allowed to enter.

A rep for Julien's says the mirror contains an inspirational message Jackson scribbled on the piece for himself regarding his This Is it concert tour -- which says, “TRAIN, perfection, March April. FULL OUT May."

The auction is scheduled to take place on Dec. 17.

The Michael Jackson Estate is lashing out at MSNBC -- saying it's "disgusted" with the network for planning to air the Conrad Murray documentary this weekend.

The Estate issued a statement ... saying, "Like so many of Michael’s fans, the Estate is also disgusted by MSNBC’s irresponsible and inexplicable decision to air a Conrad Murray 'documentary.'"

The statement continued, "The Co-Executors, John Branca and John McClain, are sending a letter to the top executives at Comcast, NBC Universal and MSNBC to express their disdain for their actions."

The MJ fans are predictably up in arms as well -- in fact, the group, "Justice 4 MJ" is trying to organize a global boycott of the documentary, "Michael Jackson and The Doctor: A Fatal Friendship" ... saying, "The only documentary we want to see is the one of Murray enjoying prison life."


UPDATE 10:40 AM: Jermaine Jackson just tweeted, "I hear all upset/frustrations re Murray doc. It's shameless & sickens me too, but I choose not to give it attention/controversy it craves."

English was not the only language used in the jury deliberation room in Conrad Murray's case ... this according to a relative of one of the jurors ... and there may have been a language barrier in the juror room.

We're told at least 2 of the jurors began discussing the case in Spanish during the 8-hour deliberation. 

A relative of one juror -- we'll call him juror A -- tells TMZ ... another juror -- juror B -- had "some trouble" understanding some of the testimony.  During the deliberations juror A had to translate the testimony into Spanish to juror B.

In the questionnaire jurors were required to fill out, the first question read, "Do you have any difficulty reading, speaking or understanding English."

TMZ has obtained a blistering letter sent to NBC and MSNBC execs from the co-executors of Michael Jackson's estate, attacking the networks' ethics for giving Conrad Murray a platform in an upcoming documentary.     
 
In the letter John Branca and John McClain grouse that Murray has no qualms about "smearing the reputation of his 'friend,'" even though he refused to testify under penalty of perjury in his trial.

In the letter, the co-executors doubt that Murray got paid only $1 for his participation in the doc.  In fact, people connected with the documentary hedged when TMZ asked about Murray's payment.

And the co-executors say, the networks are using "moral loopholes" -- claiming it was shot before Murray was convicted -- "in order to boost ratings at a struggling cable network."

A cardiology equipment company has filed a lawsuit against MSNBC and others, claiming the network should pay off a debt Dr. Conrad Murray owes them before the doctor gets a red cent for his participation in the documentary.

Digirad Imaging Solutions is a California company that obtained a $147,075 judgment against Murray because he didn't pay his bills. 

Digirad claims MSNBC, Zodiak Media Group -- the producer of the documentary -- and others might be paying Murray for the documentary, and Digirad wants its cut from the defendants before they pay the doc.

Digirad is asking for an order forcing MSNBC and the rest to pay the judgment.

La Toya Jackson is on the attack against MSNBC, claiming the Conrad Murray documentary that will air tomorrow will give "a murderer and convicted felon ... celebrity status."

La Toya fired off a letter to the network -- a letter obtained by TMZ -- in which she complains that Michael Jackson cannot defend himself against Murray's claims.  TMZ first reported, some of Murray's comments about MJ are extremely critical.

La Toya says she finds it "disgusting to permit this criminal to profit from homicidal acts that left my family without a brother, my niece and nephews without a father, my parents without a son ..."

La Toya wants the network to shelve the show, but if they don't she's asking the network to give the family an advance screening.

Dr. Conrad Murray's legal team didn't get any money -- directly or indirectly -- from the Murray documentary that's about to air on MSNBC ... this according to sources directly connected to the Dr.'s defense team.

There are reports out today that MSNBC funded Murray's legal defense, but our sources say it is "absolute B.S."   

We're told Murray's lead attorney, Ed Chernoff, is about to leave the case -- possibly before an appeal is filed -- because he needs to get back to his practice in Houston and make some money, because the Murray case almost put him under.

We're told Murray got $1 for his participation in the documentary.  But the people who are saying he got a buck will not say if he'll share in profits from selling the show.

La Toya Jackson made a valiant effort to stop MSNBC from running the Conrad Murray documentary Friday night, but in the end business is business and the network will air the show.

La Toya tells TMZ ... MSNBC Prez Phil Griffin responded to La Toya's plea directly, but she says, "due to their first amendment rights, I am unable to prevent its airing."

La Toya wants viewers to put anything Murray says in perspective, saying, "What I would encourage the public to take away from the situation is that Michael is an irreplaceable artist and human, whose talent and love for the world will forever go unmatched."

The controversial Conrad Murray documentary debuted in the United Kingdom tonight -- and in it the doctor emphatically states that AEG Live CEO Randy Phillips told him Michael Jackson does not have a "f**king cent!"

Murray claims Phillips pulled him aside after a meeting about the "This Is It" concerts and angrily said ... "What's this bullshit all about? Listen this guy is next to skid row. He's going to be homeless. Nine security guards? Why does he need that? I'm paying for that s**t. I'm paying for the toilet paper he wipes his f**king ass with."

Phillips took the stand during the manslaughter trial and -- under oath -- denied that conversation with Murray ever took place.

"Michael Jackson and the Doctor: A Fatal Friendship" also shows strategy meetings between Murray's lawyers -- Ed Chernoff and Michael Flanagan ... as well as Flanagan's wife, Susan.

During one pow wow Susan says, "Explain a 50-year-old man who sleeps with a baby doll and has pictures of basically infants to 2-year-old children looking at him every night."

Chernoff then says, "I think the media made him appear weirder than he is." Michael responds, "You gotta be kidding me, he can't be any weirder than he is."

In the docu, Murray claims Michael "always had a chamber that was exclusively his. The bedroom that he slept in ... I had to persuade him, eventually to have it cleaned. Because ... one, he peed the bed. It did not smell good. It was mildew, and I had to get it clean."

"Who would ever believe that a man his age would still be wetting his bed?" Murray added it wasn't medication that made MJ wet the bed ... he claims it was psychological.

The documentary airs in the states, Friday night on MSNBC.

Dr. Conrad Murray says he doesn't feel guilty about the death of Michael Jackson ... insisting, "I didn't do anything wrong."

The "Today" show is finally airing an intense sit-down interview with Murray that was conducted before the guilty verdict was handed down in his manslaughter case.

During the interview, Murray COMPLETELY CONTRADICTS the story he told police about what he was doing when Michael Jackson was dying on June 25, 2009.

Murray told NBC, he put MJ to sleep that fateful day ... and left the room to talk on the phone, because he didn't want to wake Michael up.

But when Murray spoke with cops, he told them a different story -- that he left the room to use the restroom ... and he was only gone for two minutes.

Murray's admission seems to change the timeline -- the NBC report says Murray was outside talking on the phone for "far longer than the two minutes he acknowledged."   

When asked if he regretted leaving the room that day, Murray thought about his answer and replied, "I regret that Michael has passed."

Dr. Conrad Murray says he didn't call 911 right away the morning Michael Jackson died because he is a "trained" cardiologist -- and he could do whatever paramedics could do.

Murray made that boastful statement during a strategy session, and appears in the documentary, "Michael Jackson and the Doctor: A Fatal Friendship" ... which first aired in the U.K. on Thursday night. However, this footage did not air in the U.S. version which aired Friday night on MSNBC.

Murray's delay in calling 911 was a key topic during his manslaughter trial -- but ultimately, his attorneys never put on any evidence to support the explanation Murray mentions in the documentary.

The doc goes on to say he would have quit working for MJ if he woke up that morning -- because Murray believes what happened to Jackson was the result of "his own hands."

Dr. Conrad Murray might have seen his eventual conviction for manslaughter coming -- because he ripped his co-counsel Michael Flanagan for screwing up a key cross-examination ... and was so angry he told his own mother to shut up!

Murray goes off ... "I take offense when my damn attorney is not prepared for that man." The rant was taped for the documentary "Michael Jackson and the Doctor: A Fatal Friendship" which aired last night on MSNBC.

Conrad Murray claims he was only trying to "tip" Michael Jackson into sleep when he gave him a "tiny bit" of Propofol the morning MJ died -- and it's the first hint at what the doctor might have said on the stand.

Murray went into stark detail about June 25, 2009 during the documentary "Michael Jackson and the Doctor: A Fatal Relationship" ... which aired on MSNBC.

In the documentary, Murray says he eventually gave in to Michael begging for "some milk" ... Propofol. Murray says he thought ... "If I give him just a tiny amount of Propofol ... 25 milligrams, slowly infused, I may just tip him into sleep ... and the other medications will now get a chance to work because he had a fair amount of medication on board."

According to Murray's recorded interview with police -- two days after MJ's death -- he had already pumped MJ with sedatives -- Valium, Lorazepam, Midazolam -- but the singer was still unable to fall asleep.

in the docu, Murray claims it was the other drugs -- not the Propofol -- that "overwhelmed" Michael. Of course, Murray also gave MJ those other drugs ... at least according to what he told police.

Maybe not testifying was for the best.

Michael Jackson took Propofol as early as 1999, a former manager claims in a new book -- and says Jackson was late to his 30th anniversary concerts because he was drugged up.

Frank Cascio, a former personal assistant to Jackson who eventually became his close friend and manager, writes that he first noticed Jackson taking Demerol in 1993 during his "Dangerous" tour. He says Jackson was first introduced to the drug in 1984, after Jackson burned his head during a Pepsi commercial shoot.

In the book, an advanced copy of which was obtained by the AP, Cascio claims Jackson took Propofol in 1999 after a stage accident in Munich.

Cascio says he spoke to Jackson's siblings about his drug use in 2001 and they tried to approach Jackson about it -- but MJ "simply pushed them away."

Writing about Jackson's death, Cascio says Michael "died in his endless quest to attain some inner peace."

Dr. Conrad Murray has been telling people who have visited him in jail ... he no longer has the will to live and he wants to kill himself.

We're told Murray cannot cope with the fact that he was found guilty of involuntary manslaughter, and even though his lawyers told him he needed to be prepared for the possibility of a guilty verdict, it never computed with him.

Sources tell us, Murray has told various people he wanted to kill himself, including baby mama Nicole Alvarez, his bodyguard Jeff and his lawyers.  He's told all of them he's lost his will to live.

We've also learned Murray remains in the medical ward at L.A. County Jail, which is where he's been for more than a week. 

Sources directly connected with Murray tell us he has no physical ailments and he is there because he's on suicide watch. 

Steve Whitmore, the spokesperson for the L.A. County Sheriff's Dept., tells TMZ they will not comment on why Murray has been in the medical ward, adding, "A person's medical or mental health status in the Los Angeles County Jail is protected under the law."

The bed Michael Jackson died on will not go to the highest bidder ... because the Jackson Estate stepped in and asked the auction house to pull it.

As we previously reported, the bed was part of a planned auction of items from the Holmby Hills mansion where MJ was living while he prepped for the "This Is It" comeback. 

Julien's Auctions says the mattresses were never for sale -- they were removed as evidence after MJ died.

The rest of the items will go up for auction as scheduled next month.

Katherine Jackson is upset she had anything to do with the recent Michael Jackson Tribute concert -- telling TMZ, Global Live better take care of the workers they allegedly failed to pay.

Scores of crew members recently went on Twitter to slam Global Live -- the concert producers -- and insist the company stiffed them after they busted their asses for the event.

Katherine's lawyer tells us, "After Mrs. Jackson did all she could to help promote and make this a great event for all of Michael's fans, she is extremely displeased to hear that concert promoters have allegedly failed to pay their bills."

The lawyer adds, "Katherine is hoping that they step up and take care of their obligations." So far no word back from Global Live.

Conrad Murray's lawyers will ask Judge Michael Pastor for mercy when he's sentenced on November 29 -- mercy in the form of probation ... sources directly connected with the case tell TMZ.

We're told attorneys Mike Flanagan and Ed Chernoff will argue ... Murray has no criminal history, and he's been a model citizen and good doctor for all of his professional life -- except, of course, with the whole Michael Jackson thing.

Sources say Murray's lawyers are getting statements from the doc's patients, to demonstrate his commitment to good medicine. 

Murray faces a maximum of 4 years in State prison, although he will never serve a day in prison because of a new California law.  If Murray is sentenced to 4 years, he'll serve a maximum of 2 in L.A. County Jail, and he could be eligible for house arrest.

Several items from the upcoming Michael Jackson death house auction -- including a mirror from MJ's inner sanctum -- contain messages the public was never meant to see ... and now, TMZ has obtained pictures of the secret inscriptions.

The mirror reads "Train, perfection March April Full Out" ... and according to a rep for Julien's Auctions -- the company behind the sale -- Jackson wrote the motivational message to himself in the months leading up to his "This Is It" tour.

The chalkboard on the right contains a heartbreaking message from one of Michael's children -- "I love Daddy. Smile, it's for free!" Both the mirror and the chalkboard have remained undisturbed since the singer's death.

Clearly, neither message was intended for public viewing -- but we're told the items are hitting the auction block on December 17 ... as is.

The prosecutor in the Conrad Murray manslaughter case will ask Judge Michael Pastor to sentence the doctor to the maximum -- 4 years in State Prison ... TMZ has learned.

The D.A. just filed legal docs with the judge for the sentencing on Tuesday.

As we have already told you ... even if Murray gets 4 years, he will not spend a single day in prison because of a new California law.  He will go to L.A. County Jail, where a 4-year sentence would be whittled down to 2 years.  And, on top of that, Murray would be eligible for house arrest.

As we already reported ... Murray's lawyers will ask the judge to place him on probation.

Prosecutors in the Conrad Murray manslaughter case are asking Judge Michael Pastor to order the doc to pay Michael Jackson's children more than $100 million for their loss.
 
According to new court docs filed by the D.A., Michael Jackson's kids are "entitled to wages or profits lost due to injury incurred by the victim."

Prosecutors say MJ's 3 kids are victims under the law, and are entitled to restitution from Dr. Murray ... which include wages, lost profits and funeral expenses.  The D.A. cites a letter from the MJ Estate, estimating Michael would have made $100 million in revenue from the "This Is It" tour. 

As we first reported, the D.A. is also seeking the maximum punishment -- 4 years in State Prison.  The D.A. says they are seeking the max because Murray was "risking Mr. Jackson's life every night" by administering Propofol.  And the D.A. says, MJ was a "particularly vulnerable victim."  And the D.A. says, Murray lied and covered-up his crime.

Lindsay Lohan's lawyer is coming to the defense of Conrad Murray ... claiming the Doc should NOT get the maximum sentence for manslaughtering Michael Jackson ... because it just wouldn't be fair.

With Murray's sentencing hearing set for tomorrow in L.A. -- we asked the effervescent Shawn Holley if Conrad deserves the 4 year prison sentence he's expected to receive.

Holley makes it clear she doesn't excuse Murray's "horrible" crime ... but claims he shouldn't get the full sentence because, "He has no record."

Murray's hearing is set to begin at 8:30 AM tomorrow -- TMZ will be livestreaming the whole thing.

Dr. Conrad Murray's mother says she's "suffering" from overwhelming sadness because her only son is incarcerated -- and has begged the judge to go easy on the Doc when it comes to his sentence.

Mrs. Milta Rush sent a letter to Judge Pastor -- explaining why Murray deserves mercy ... because he's a good person who has "never drank alcohol, took drugs or smoked cigarettes in his life."

Milta explains, "He has never been in trouble with the law before and I am barely standing, scared and worried sick about him being incarcerated."

"He is saddened and remorseful about the death of his friend Michael Jackson and I do believe he is certainly learning the toughest lesson of his life."

Milta continues, "I sympathize with Mrs. Jackson as a mother; I feel her pain for having lost her son. I sense she was very close to her son. I really wanted to approach her personally and tell her I am sorry for the loss of her son but I was unsure if she would be receptive, and I did not want to take the chance of violating the courts rules. I am sorry for her loss."

"Judge Pastor, Conrad, is my son and as a mother I must say I know him inside out. He is sorry for what happened to Michael and had no intent towards him."

"I humbly beg for your heart felt  consideration of everything I have said about Conrad, and ask for your compassion and leniency in giving him probation or community service."

Dr. Murray's sentencing hearing is scheduled for tomorrow.

Michael Jackson's older brother Marlon wants Judge Pastor to throw the book at Dr. Conrad Murray today -- but he insists Conrad's real punishment will come from God himself.

Marlon flew in to LAX yesterday -- presumably for today's sentencing hearing -- and told us he hopes Murray gets the maximum sentence ... but explains, "The real verdict will come down not on planet Earth ... the Lord will take care of what he needs to take care of."

The hearing is set for 8:30 AM PST -- we'll be livestreaming the entire thing.
