Auction House, Michael Jackson's Estate To Be Taken To Trial Over Cancelled Auction

A judge ruled today that a collector suing Michael Jackson's estate and an auction house for $5 million over a canceled auction of the singer's memorabilia can take his case to trial, but trimmed some of the allegations in the complaint.

The decision by Los Angeles Superior Court Judge Ronald Sohigian means a jury will decide Richard LaPointe's causes of action for alleged intentional infliction of contractual relations and breach of contract against Julien's Auction House and the Jackson estate, said plaintiff's attorney Andrew Krastins.

The allegations eliminated by the judge included negligent interference with contractual relations, Krastins said.

Krastins hailed the ruling, saying it means his client can seek punitive damages and that the Jackson executors may have to reveal the extent of the estate's assets.

The auction, which would have been the largest authorized sale of items associated with Jackson, was canceled in April 2009 after the singer reached a legal settlement with Julien's Auction House. Jackson died two months later at age 50.

The 1,400 items that were to be auctioned off included Jackson's large collection of antiques, decorative arts, costumes, music awards and other items that were once in his Neverland mansion in Santa Barbara County.

Lapointe filed the lawsuit in October 2009, claiming ownership of 82 items on which he bid online ahead of the auction.

He was the only bidder for those items, including a replica classic automobile used by Jackson to provide transportation to celebrity guests at Neverland.

LaPointe also has one of the world's biggest collection of Beatles memorabilia.

All right, this is interesting news. Michael had a contract to sell his items before "death". had got a contract with Richard, then cancelled in April, then got another contract with Juliens Auction House TO SELL HIS ITEMS. Why would Michael needed to sell his items at that time? Was he already going to say bye, bye to King of Pop? Nevertheless, if Michael cancelled his contract with Richard himself "while he was alive", Richard cannot do anything with his filed lawsuit.

WHY would he need to know that!?
From the way this reads he should only be
legally disputing the 82 items he said he purchased online.

IMO The auction was canceled then too bad...unless this guy actually paid for them when he bought them online.

It clearly says,,,"claiming ownership of 82 items on which he bid online ahead of the auction."
The  question is did he PAY for them? If not he should not even BE in court. Uhhhh.

This one tells me something different than the other court situations.  With Katherine dropping the AEG suit, well, we expected this.  And now the Murray trial not preparing and probably stalling the date...again, of course.  How do these two go to court with Michael alive?
But, this auction...they wanted to sell Michael's stuff, thinking there'd be tons of cash with Michael dead.  BUT....MICHAEL wants his stuff!!!!!  Of course.  He has made so much money being dead (LOL) that he don't need to sell his things.  So this auction house wants the money they'd have made.  This one makes sense and also tells me Michael is alive because otherwise the estate would sell!!!!  What could they do with all this stuff, store it someplace?  Michael probably DOES still own Neverland and it's going back in at one point. :))
