AEG Drops Michael Jackson Insurance Claim

A Lloyds of London underwriter sued AEG and Michael Jackson LLC after Jackson's death

LOS ANGELES (CNN) -- AEG dropped its claim Monday for a $17.5 million insurance policy for Michael Jackson, just days after e-mails revealed the concert promoter had doubts about Jackson's health at the time they were applying for the insurance.

A Lloyds of London underwriter sued AEG and Michael Jackson LLC after Jackson's death, claiming they failed to disclose information about the pop star's health and drug use.

"In exchange for AEG withdrawing its insurance claim, underwriters agreed to dismiss AEG from the case and to waive any costs recoverable from AEG," said Paul Schrieffer, attorney for the insurance underwriter. "The insurance case continues against the Michael Jackson Company LLC for, among other things, rescission of the policy due to nondisclosures of Michael Jackson's prior drug use."

Lawyers for AEG and the Michael Jackson estate, which controls Michael Jackson LLC, did not immediately respond to CNN's request for comment Monday.

Jackson died of an overdose of a surgical anesthesia in combination with sedatives on June 25, 2009, according the the Los Angeles County coroner. Dr. Conrad Murray was found guilty last year of involuntary manslaughter in Jackson's death.

A controversy over the insurance claim erupted last week after the Los Angeles Times published e-mails which the insurance lawyer said had not been provided to him despite a year of discovery in the case.

The settlement was announced Tuesday in a Los Angeles federal courthouse right before a trial on damages was scheduled to begin. The estate had sued Howard Mann and his businesses in January 2011, claiming he had violated Jackson copyrights in a book and other merchandise he sold in collaboration with Katherine Jackson.

Mann is the CEO of Vintage Pop Media, which according to settlement terms announced in court is responsible for paying the judgment.

A judge had already ruled that Mann and Vintage Pop Media violated copyrights by using images from the Jackson film "This Is It" and other works.

A jury trial on how much Mann owes the estate had been scheduled to begin Tuesday, with an expert estimating a license for the works is with between $5 and $12 million.

Michael Jackson’s brother Jermaine, has released a follow up statement, this time regarding his Michael Jackson book:
Quote

Many of you have asked about my book’s timing in light of my comments about the tribute concert, so let me explain.

When I first signed the book deal, the agreed publication date was October 13. When the courts moved the trial date from June to September, that meant the book would come out in the middle of those proceedings — an outcome I couldn’t allow.

Once I explained this to the UK & US publishers, they both understood and acted swiftly, going to great lengths to rearrange their ‘locked in’ schedules.

I was offered two alternative publication dates: first week November or second week September. To avoid a potential clash with any jury deliberations/verdict in the November, I agreed September 13 because it’s BEFORE the trial’s start on September 20.

Where my publishers listened and acted to avoid conflict with the trial, Global Live, the promoters behind the tribute concert, heard my same concerns and stuck to their October 8th concert date. There is the difference.

I will not be promoting the book or doing any book signings after September 20 and until the trial has ended.

Jackson family lawsuit can proceed against AEG

LOS ANGELES (Reuters) - A judge on Wednesday ruled the wrongful death lawsuit filed by Michael Jackson's mother can proceed against concert promoter AEG Live, setting up a legal showdown between Katherine Jackson and the company she blames for the "Thriller" singer's demise.

The lawsuit accuses AEG of being responsible for medical decisions made by Jackson's physician, Dr. Conrad Murray, whose care was funded by the company.

Murray is charged with involuntary manslaughter in connection with Jackson's June 25, 2009, death, age 50, from an overdose of the powerful anesthetic propofol which the doctor gave as a sleep aid and other sedatives and painkillers.

Los Angeles Superior Court Judge Yvette Palazuelos on Wednesday denied a motion by AEG, a subsidiary of the Anschutz Entertainment Group, to dismiss Katherine Jackson's case against the company.

But the judge said lawyers for the singer's 80 year-old mother would need to show evidence of fraud, negligent infliction of emotional distress and civil conspiracy.

Palazuelos said she had doubts about civil conspiracy, because there were no details in the lawsuit saying AEG and Murray had an agreement to break the law, in providing medical care to Jackson.

"If the object was to get him to rehearsals, I don't see that as a wrongful or illegal act," she said.

Jackson was preparing for his "This Is It" series of 50 comeback concerts in London when he died, and Murray was going to accompany him to Britain for the shows.

AEG attorney Marvin Putnam, in arguments before the judge, said the company could not have realized beforehand that Murray's medical decisions would lead to Jackson's death.

"It's not foreseeable that Michael Jackson or anyone else was going to die in their own home of propofol," Putnam said.

During a preliminary hearing last month in the criminal case against Murray, witnesses testified that propofol is administered in surgery and never recommended for home use.

The judge in that separate case found there was sufficient evidence to try Murray, and he wondered out loud why the doctor would have used propofol on Jackson as a sleep aid.

Murray's involuntary manslaughter trial is scheduled to begin on March 28. He faces a maximum of four years in prison.

Katherine Jackson's wrongful death lawsuit was filed in September and includes the singer's three children as co-plaintiffs.

Kenny Ortega, a choreographer who was directing Jackson's rehearsals, was originally named as a defendant. But Katherine Jackson's attorneys recently dropped him from the suit, citing new information.

In court papers, AEG's attorneys said the company "did not choose or hire Dr. Murray" and merely conducted negotiations aimed at "retaining him as an independent contractor."

The next hearing in Katherine Jackson's civil case is scheduled for March 22.

By DON BABWIN, Associated Press Don Babwin, Associated Press – Mon Jan 24, 11:23 pm ET

CHICAGO – Oprah Winfrey has discovered she has a half-sister — a Milwaukee woman who was given up for adoption by Winfrey's mother nearly 50 years ago, when the talk show host was eight years old.

An emotional Winfrey introduced her newly found sibling to viewers Monday and explained the woman's persistent quest to find her birth mother.

"This, my friends, is the miracle of all miracles," Winfrey said before bringing out the 48-year-old woman, who throughout the program was identified only as Patricia, with no mention of her occupation or any other details.

After years of searching for blood relatives, the woman met Winfrey on Thanksgiving Day of last year.

When Patricia was born in Milwaukee in 1963, the young Winfrey was living with her father and did not even know her mother was pregnant, she said.

Patricia, who Winfrey said bounced from foster home to foster home until she was adopted at age 7, had given up after previous searches for her mother. But she decided to resume looking several years ago at the insistence of her grown children.

The effort seemed to hit a dead end when a woman from the Wisconsin adoption agency called to respond to her inquiries.

"She was telling me that my birth mother had called her back, and she had made the decision at that particular time that she did not want to see me," Patricia said.

Coincidentally, on the local news that day was a story about Winfrey' mother, Vernita Lee, who revealed details about two of her children who had since died. Those details, Patricia said, matched information she had seen in papers about her own adoption.

Winfrey's mother also said that one of the deceased children had been named Patricia.

"The hairs on the back of my neck stood up," Patricia said. "Because I knew one of my siblings and I shared the same name."

Later, she found more matching details, including the fact that Winfrey was born in 1954, the same year as the woman Patricia knew was her surviving sibling.

Patricia found the daughter of Winfrey's dead sister in Milwaukee, and they took a DNA test that confirmed their relationship.

Lee, who recently suffered a minor stroke, said she never told Winfrey about her half-sister, "because I thought it was a terrible thing for me to do, that I had done, gave up my daughter when she was born."

Winfrey said documents from the girl's birth reveal that Lee gave up the baby for adoption because she did not think she could get off welfare if she kept the child.

"I made the decision to give her up because I wasn't able to take care of her," Lee said during a recorded interview that aired Monday. "So when I left the hospital, I told the nurse I wasn't going to keep the baby."

Winfrey said she was particularly stunned by the news because of the way it came out.

She said Patricia had known since 2007 that the two were related, but never attempted to profit off her discovery, even as she tried unsuccessfully to contact Winfrey, her mother or others in Winfrey's family.

Had Patricia sold her remarkable story to the tabloids, she would have likely received a healthy sum for the exclusive. A magazine cover story can earn as much as $75,000, and given that Patricia's half-sister turned out to be one of the largest figures in the entertainment world and one of the wealthiest women in the United States, her theoretical payday could have been even more.

"She never once thought to sell the story," Winfrey said, recalling how she felt betrayed by others who have sought to take advantage of their relationship with her.

Winfrey, for example, recalled how her other sister revealed to the press years ago that Winfrey had had a baby when she was a teenager. The baby, Winfrey has said, died shortly after birth. And she talked about putting her sister in rehab twice for drug addiction, but that her sister ultimately died.

Patricia said she didn't consider revealing that she and Winfrey were half-sisters to anyone but Winfrey, explaining that she did not want to hurt Winfrey.

"Family business should be handled by family," Patricia said. "It couldn't be handled by anyone else. That's not fair. It wouldn't be fair to you."

Winfrey said she was heartened by learning that she had a half-sister, saying it "feels like closure" for the sister who died.

"It feels to me like you are Pat on her very best day," Winfrey told the woman. "You are what she wanted to be without the drugs."

LA DA Gives Michael Jackson’s Killer The Deal Of A Lifetime

Los Angeles County District Attorney Steve Cooley’s decision to indict Michael Jackson’s murderer with the reduced charge of involuntary manslaughter may to some appear to be the maximum charge he could have made — this being LA and all.  Then when you listen to what Cooley’s associates have to say about the guy, you have to wonder if the DA is actually using the legal system to benefit his own political end.

Anyone who’s ever had cause to observe the over-the-top practice of LA prosecutors with respect to indicting so-called racial “minorities” will tell you that the average DA in Cooley’s office would have conducted a vigorous, even if not thorough, investigation before aggressively charging Dr Conrad Murray.

Deputy DA Steve Ipsen in a no-holds-barred video tells the Full Disclosure Network that Cooley is “very selective” and “does not prosecute all corruption.”  He does not investigate the rich and powerful because it may cost him campaign contributions.  He also fails to investigate environmental crime, and refuses to investigate child abusers “that still work in the Catholic Church.”

He says Cooley gave himself a birthday party but didn’t invite the staff from his own office.  Mainly criminal defense lawyers showed up “and each gave him 1000 dollars to his campaign.”

Albert Robles Water Replenishment Board member and candidate for LA County DA says much the same about how Cooley over politicizes the DA’s office.  He accepts money from criminal defense attorneys. Political law violators hire attorneys who are friends with Cooley and he gives them a break by “undercutting” the DA who’s handling the case, he added.

Robles says its human nature that when someone helps you out and later approaches you for a favor, you’re going to help that person, but it’s not fair to the DA who’s been working on the case.

Ispen and Robles make it appear as though the man is not above accepting “bribes,” stating that if a criminal defense attorney has a client he wants to protect, all he has to do is invite Cooley out for a drink and offer to make a contribution to his political campaign.

While Cooley’s predecessor, Gil Garcetti, was upfront regarding his draconian three-strikes sentencing policies for the pettiest of crimes, Steve Cooley prefers to keep a low profile, “you won’t find his face all over the nightly news.”

In 2000, Cooley beat DA Garcetti in their race for Los Angeles County District Attorney.  At the time, Garcetti’s disapproval rating was up around 70 percent which made him particularly vulnerable.  Even to Cooley.  It was said of Steve Cooley at the time that his greatest asset for the job of County DA was that he was the “un-Garcetti.”

As a former police-reserve officer with close law-enforcement ties, Cooley was endorsed by virtually every rank-and-file police organization in the county.  Even though his political views were the same as Garcetti, he moved to the center in order to win over liberal-hearted voters.

For the past 10 years, Steve Cooley has been the DA of LA County but is now seeking the office of state attorney general.  While I’m sure the contributions from Cooley’s lawyer friends were much appreciated, and should aid him in his endeavor to become the next top DA in California.  However what the lawyers donated is nothing compared to the contributions of corporate donors who usually do the heavy lifting in major political campaigns.

The corporate donors I refer to here are Sony Music Publishers, AEG Live, and John Branca’s law firm all whom are major political donors and share an association with the doctor, Michael Jackson’s killer.

Because of Cooley’s track record of not vigorously pursuing certain crimes, there is little doubt that the AEG Live donation, recently reported in the press, may have had something to with Murray receiving what amounts to the deal of a lifetime.
