Okay, now they claim Michael drank the propofol?

You are not allowed to view links. Register or Login

Hinting at how they intend to get Dr. Conrad Murray off the hook, his defense team continues to float trial balloons of how they’ll plant reasonable doubt in jurors’ minds.  Dying from a Propfol overdose at age 50 June 25, 2009, pop singer icon Michael Jackson was on the threshold of restarting his brilliant career, winning him more Grammies, platinum albums and praise from a worldwide audience.  When he hired 57-year-old Trinidad-Tobago-born physician Dr. Conrad Murray in May 2009 for $150,000 a month, he thought he was in good hands.  Preparing for a 50-concert British Tour, Jackson had just finished a powerful dress rehearsal at Los Angeles’ Staples Center the night before he was found dead in the morning of June 25.  Murray treated Jackson’s insomnia by administering Propofol, a common short-acting anesthetic used by qualified anesthesiologists in certified operating rooms.
Murray set up an intravenous drip in Jackson’s bedroom, administering various doses of Propfol to keep Jackson asleep, without proper training or monitoring equipment.  Never before had Propofol been used to treat insomnia.  Only Murray’s distorted thinking and poor judgment created such a high-risk procedure, acceptable to no one but him.  When his patient died from his gross negligence and incompetence, he scrambled to cover his tracks, fleeing from the crime scene, until the Los Angeles Police Department tracked him down.  Now facing trial for felony involuntary manslaughter, Conrad put the blame on Jackson, not on himself.  When Michael finished hours of grueling dress rehearsals, no one questioned his fitness.  Only after Murray overdosed Jackson does his he want to blame the mishap on Jackson’s failing health and history of drug abuse.
Showing their cards, Murray’s lawyers seek to blame Jackson’s death on (a) his failing health and (b) on a voluntary self-administered Propofol overdose. Consistent with Los Angeles County Coroner Feb. 8, 2011 findings, the Murray’s defense claims Jackson had Profofol in his stomach, signaling the pop singer drank Propfol from a bottle without the doctor’s knowledge.  Murray pleaded not guilty Jan. 25, 2011 to involuntary manslaughter charges, despite Los Angeles Superior Court Judge Michael Pastor’s finding that there was sufficient evidence to proceed to trial.  Murray told police that Jackson “craved” Propofol, referring to the drug as his “milk,” something related to the drug’s milky appearance.  Traces of Propofol in Jackson’s digestive tract doesn’t automatically mean the pop singer swallowed it himself or, for that matter, that Murray is off the hook.
Murray’s self-concocted insomnia machine, hooking Jackson up to an IV and administering Propofol without any medical precedent or proper training, constitutes gross negligence, warranting the more severe charge of voluntary manslaughter or even second degree murder.  Regardless of Murray’s intent, acts of gross negligence that result in the death of innocent patients warrant more that involuntary manslaughter.  Given the Los Angeles County District Attorney’s decision to try Murray for involuntary manslaughter, there’s plenty of evidence for conviction.  Murray’s defense team hopes to hang the jury with enough “reasonable doubt” with respect to the coroner’s findings.  When Jurors hear testimony from medical experts at how utterly outrageous Murray’s Propofol insomnia treatments crossed the medical line to gross negligence, trace amounts in Jackson’s stomach won’t matter.
Whether the coroner found trace elements of Propofol in Jackson’s stomach has nothing to do with gross negligence by treating insomnia with fast-acting anesthesia.  Murray had no business giving Jackson Propofol or creating a dangerous, untested treatment that resulted in Jackson’s death.  He can’t argue with a straight face that Jackson killed himself when he engaged in such gross negligence, no matter how well intentioned, or, for that matter, whether Jackson asked or begged for the treatment.  No responsible physician gives a patient dangerous treatment simply because of patients’ demands.  “Jackson could have swallowed Propofol,” said anesthesiologist Dr. Barry Friedberg,” signaling at Murray’s defense.  Whether Jackson “self-ingested” Propofol or not doesn’t excuse Murray from engaging in the egregious gross negligence that caused Jackson’s death.
When Murray found Jackson lifeless in the morning of June 25, 2009, he did everything in his power to cover-up the crime scene, dispose of evidence and escape police questioning.  Now that he’s about to stand trial for involuntary manslaughter, his defense team led by Atty. Ed Chernoff seeks any way to find reasonable doubt.  “I’m curious as to how ‘safe’ Dr. Friedberg thinks a doctor must be to prevent a patient from injecting himself or drinking as drug when he leaves the room,” asked Chernoff rhetorically, floating too much info before trial.  Chernoff must convince a jury that Murray—without proper training, equipment or medical precedent—did not engage in gross negligence, administering Propofol for Jackson’s insomnia.  Diverting jurors’ attention on what the coroner found in Jackson’s stomach doesn’t excuse Murray’s gross negligence and guilt.

TMZ has obtained a 30-second clip from what could be a historic recording of Elvis & Jerry Lee Lewis back in 1960 -- their only duet in existence -- but there's a problem ... some people claim it ain't legit.

The clip allegedly features Elvis and Jerry Lee Lewis shooting the breeze at Jerry's house -- and based on the audio, Jerry's a big fan of the King.

A guy named Rod Lambert from Nashville tells TMZ, he bought the tape over ten years ago at a yard sale ... and only recently discovered that he could have a piece of rock and roll history on his hands.

An audio forensics expert verified that the voices on the tape were indeed Elvis and Lewis ... but Lambert -- who posted more of the clip on his website -- tells us, the company in charge of Elvis' catalog denied it was really the rock legend.

Lambert claims the full 30-minute version of the tape contains some pretty explicit dialogue -- and although Elvis doesn't say much ... according to Lambert, Lewis wasn't so cautious, saying things like, “If you don’t like Jerry’s peaches, then get your f**kin’ ass away from my tree."

Quincy Jones / Quincy Jones Not Thanked By Jacksons

Quincy Jones has criticised Michael Jackson's family for never thanking him for the work he produced with the late singer.
Quincy Jones was never thanked by the Jackson family for his work with Michael Jackson.
The producer worked with the late singer on his most successful albums 'Off The Wall', 'Thriller' - the biggest selling album of all time - and 'Bad' but says his family, in particular father Joe Jackson, have never thanked him for his hard work.
When told Joe claims he was in the studio every day with Michael when he was recording, Quincy replied: "He's a liar. He takes the p**s. Not once did the family ever thank me for doing what we did, not once nobody. Of course, Michael thanked me but that's it."
Quincy also said that in his role as a producer and musician he always thinks in terms of colour and tries to imagine songs visually before creating them.
He added: "I was in art first, you know and I think in terms of sketches, watercolours and oil, psychological thing. I think in images all the time."
Quincy has worked with some of the biggest artists in the modern era, and also told how confidence in your work is key if you're going to cut tracks with some of the most revered artists of the modern era.
He added: "It's a process man, a never ending process, and you have to go and use your judgment with it. When you tell artists like Frank Sinatra and Ray Charles to jump without a net you gotta know what you're talking about. I was ready for Frank though, I've been doing this since I was 13, but you better have it together, because he'll watch you like a hawk."

Okay, I'll readily admit that I don't particularly care for QJ, but I can't see any reason why he thinks Michael's family should thank him.  I mean, get over yourself already.

The song -- "Opis None" -- was pulled from the archives of JacksonSecretVault.com ... a company in which Katherine Jackson is a partner. The company owns nearly 300 unreleased MJ tracks ... along with never-before-seen video and memorabilia.

Howard Mann, Katherine's partner in the company, tells TMZ, "In an effort to overcome the confusion as to the authenticity of the track the estate has recently released we want to give an actual authentic Michael Jackson track to the world ... for free."

Sony released a teaser of an upcoming MJ album, which various experts have authenticated as the real deal.

Heifer International

To End Hunger & Poverty
Heifer’s mission is to work with communities to end hunger and poverty and care for the earth.

By giving families a hand-up, not just a hand-out, we empower them to turn lives of hunger and poverty into self-reliance and hope.

With gifts of livestock and training, we help families improve their nutrition and generate income in sustainable ways. We refer to the animals as “living loans” because in exchange for their livestock and training, families agree to give one of its animal’s offspring to another family in need. It’s called Passing on the Gift – a cornerstone of our mission that creates an ever-expanding network of hope and peace.

Katherine Jackson / A Thought on Katherine
« on: November 02, 2010, 11:11:07 PM »
I was just wondering...why does Katherine need to be out in front of the cameras so much?

I know the popular opinion is that she's playing her part in the hoax; she's revered by Michael so her words will hold more weight with fans; people feel for her as a mother; she's trying to set the record straight for Michael, etc.  But...

The woman is 80 years old and never craved the limelight.  I'm sure the world (that thinks Michael is dead) would totally understand if she quietly raised Michael's kids and lived out her life.  God knows there are plenty of family members to get Michael's message out; it doesn't have to be Katherine.  People constantly comment about how she looks so pained having to lie and how difficult all this must be on her.  I just feel Michael would never want to put her through that - even for the greater purpose of this hoax.

So why?  Why the Oprah interview?  Why the book?  Why any of it?  Why her?  Yes, as a mother she would do anything for her son but as a son, would Michael really ask that of his mother?  It just doesn't connect for me.

Top-Earning Dead Celebrities
Lacey Rose and Dorothy Pomerantz 10.25.10, 3:00 PM ET

Michael Jackson never graced Forbes’ annual Celebrity 100 list during his life. In death, the King of Pop earned more in the past year than any star on that list, apart from Oprah Winfrey.

Jackson not only took the No.1 spot on our 10th annual ranking of the Top-Earning Dead Celebrities, with gross earnings of $275 million, he out-earned the other 12 deceased stars on the list combined. Still more impressive: His estate's 12-month haul was greater than the pooled earnings of this year’s two biggest living acts, U2 and AC/DC. Jackson’s posthumous earnings come from his stake in the lucrative Sony/ATV catalog, the hit Sony film This Is It and renewed fan interest in music, videos and all things Michael Jackson. (See "The Corpse King Of Pop")

“The death of Michael Jackson really put a focus on--crassly, quite frankly--what someone’s worth when they’re deceased,” says David Reeder, vice president of Corbis' GreenLight, which manages the personality rights for Albert Einstein and Steve McQueen, among other dead celebrities. “In a more positive way, it exposed consumers to this idea that there actually is a market for, and an enduring legacy for, these people.”

To place on this year’s list, a deceased celebrity needed to earn at least $5 million between Oct. 1, 2009, and Oct. 1, 2010. For the most part, earnings come from things like music royalties (John Lennon), book sales (Dr. Seuss) or the licensing of one’s image and likeness (McQueen). To compile the list, we spoke to agents, lawyers and other sources to estimate a star’s gross earnings (before taxes, management fees and other costs).

Coming in at No. 2 is Elvis Presley. The King of Rock n’ Roll's estate pulled down $60 million in the 12-month period, thanks to Graceland admissions and a heavily hyped Cirque du Soleil show in Las Vegas. The estate's portfolio of more than 200 licensing and merchandise deals got a nice boost from the late star's 75th birthday celebration as well.

Stieg Larsson, author of The Girl with the Dragon Tattoo, debuts on this year’s list at No. 6 with $18 million in earnings. The Swedish writer died in 2004 at the age of 50, before any of the books in his Millennium Trilogy were published. They have since sold 40 million copies, been translated into 44 languages and spawned three hit Swedish movies.

No surprise, Hollywood has come calling. A U.S. version of the first book, The Girl with the Dragon Tattoo, is scheduled to hit theaters next December. The film will be directed by The Social Network’s David Fincher and star Daniel Craig as hero Mikael Blomkvist. A cut of the money from the American movies (and a reported fourth book) will go to Larsson’s estate, which is being fought over by Larsson’s longtime girlfriend and his brother and father.

Also new to the list is New York Yankees icon George Steinbrenner, who ranks ninth with earnings of $8 million. The legendary owner passed away this summer at the age of 80, but his estate continues to cash in on the team’s success. The Yankees have a lucrative stake in the YES regional sports network, and Steinbrenner's estate receives a cut of sales from the team's merchandise.

Many dead celebrities make the bulk of their posthumous fortunes on licensing deals. Unlike their living counterparts, who can suddenly fall into a heap of trouble (see Lindsay Lohan, Mel Gibson), dead celebrities have images--be they glamorous, rebellious or tough--that are unlikely to change. For that instant and considerably safer brand association, marketers are increasingly attaching themselves to the dead, says Mark Roesler, chief executive of CMG Worldwide.

Take Steve McQueen, who returns to the list at No. 11 with $6 million. The Bullitt star continues to personify cool three decades after his passing, and advertisers have taken notice. His image has been licensed to high-end brands like Dolce & Gabbana and Persol sunglasses. More recently, his likeness was used for Tommy Hilfiger’s fall “icon collection” and UBS' global “We Will Not Rest” campaign.

Doctor charged in Michael Jackson's death due back in Los Angeles court for status hearing
The Associated Press
LOS ANGELES October 26, 2010 (AP)

The doctor charged in Michael Jackson's death is due back in a Los Angeles courtroom Tuesday afternoon for a status hearing.

Dr. Conrad Murray, who has been charged with involuntary manslaughter in Jackson's 2009 death, is expected to attend the hearing.

Los Angeles Superior Court Judge Michael Pastor scheduled the hearing to receive updates on attorneys' preparations for Murray's preliminary hearing, which is scheduled to begin in January. During that hearing, the judge will determine whether there is enough evidence for the cardiologist to stand trial.

Murray is accused of giving Jackson a lethal dose of sedatives, including the anesthetic propofol. He had been hired to serves as the singer's personal physician during a series of comeback concerts.

Paris, Prince Jackson May Testify at Doctor's Trial
Conrad Murray thinks they'll help his case

(Newser) – Things seemed to be going pretty well for Michael Jackson’s children, but that may not last long. Dr. Conrad Murray, who will stand trial for manslaughter in Jackson’s death, plans to call Prince and Paris Jackson to the stand. “Prince and Paris knew their dad relied on Dr. Murray to survive and knew their father adored him,” a source tells Radar. Murray expects the children to admit their father was addicted to drugs, and specifically wants Paris to testify to statements she reportedly made soon after Jackson’s death.

“After saying goodbye to her dad at the hospital, Paris said, 'My daddy is so cold again. He was always cold. He would sit by the fire to get warm. We were always afraid he would fall in. ... He couldn't get warm. Now there he is ... so cold,” the source says. “Their comments, if they back him, could save him from jail because it would work well in the eyes of a jury.” Murray’s lawyer denies the report.

I put the last sentence in bold because I didn't see the denial in other reports of this story.  Notably, TMZ did not break this one (unless I missed something).  Personally, I don't think it has any merit and I question any connection to the hoax.

Joe Jackson Will Ask Court To Remove Michael Jackson Estate Executors
9/6/2010 3:02 PM ET

(RTTNews) -  Joe Jackson, father of the late pop star Michael Jackson, has been granted a hearing on October 6 to attempt to remove the executors of his son's estate.

The older Jackson, who was not named in his son's will, is expected to argue that he should have a say in the potential executors of his son's estate because he was financially dependent on his son Michael. He has therefore requested the removal of the currently-named executors - Michael Jackson's attorney John Branca and music executive and family friend John McClain.

Said his attorney Brian Oxman, "I think it's an important issue for all fathers around the country and around the world that when their child dies they should have a say-so in their child's estate."

Meanwhile, lawyers for the estate stressed that all obligations to named beneficiaries are being met, with attorney Howard Weitzman dismissing Jackson's claims, "As I've said before, Mr. Jackson's appeal is not well taken."

Jackson is currently pursuing a wrongful death suit against his son's doctor, Conrad Murray, who is accused of administering the lethal dose of Propofol responsible for the King of Pop's death.

Michael Jackson's Dad Gets Appeal In Estate Case
The hearing will happen on October 6th...
12:55, Friday, 3 September 2010

An appeals court has granted Michael Jackson's father Joe the right to argue that he should be involved in the decisions regarding Jacko's multi-million dollar estate.

The Second District Court of Appeal has scheduled a hearing for Joe Jackson and his lawyers to make their case on October 6th 2010.

The decision comes after MJ's father challenged a ruling by the state judge that his late son's estate would not be managed by the Jackson family but was to be run by attorney John Branca and music executive John McClain.

Joe's lawyer Brain Oxman has since stated: "I think it's an important issue for all fathers around the country and around the world that when their child dies they should have a say-so in their child's estate,"

Reports suggest that Mr.Jackson's appeal is 'not well taken' by the opposed, with their attorney Howard Weitzman reiterating the point after his recent attempt to challenge the stat judge's ruling.

Random MJ Talk / Having doubts on an emotional weekend
« on: July 18, 2010, 06:45:49 PM »
This is kinda long and I apologize, but I just had to talk to somebody...

It's been an emotional weekend for me, for a few different reasons.  So watching the special features on the This Is It DVD for the first time this afternoon was probably not the best idea, but I've been reading the TIAI threads and thought I might find some more clues that were talked about.

Staging the Return and Memories of Michael gave me really conflicted feelings.  Hearing all these people talk in the past about him, even Kenny, Travis, and Frank - people who really know him - I mean, it's really hard for my logical mind to believe that they were all doing it for show.  I know they've contradicted themselves and slipped up since then, and so I tried seeing it from a hoax perspective.  Some of what they said could have double meanings, but it's still hard to believe they could talk about him that convincingly if it were all a sham - even if they are doing it to help Michael.

In so many ways, these outtakes were more powerful than the actual movie.  The finished film seemed "all business" - all about the show - and it's easier to say that it was all planned out that way.  Then I see the outtakes with the MJAir plane finale, which never made it to the movie (for obvious reasons) and ask:  If this was all orchestrated, why have all these people put all this effort into an effect that never even made it to the film?  Why would Michael sit around in a room with these people for hours on end going over concepts that were never going to be?  The only way I can explain it is that Michael was fully planning to go through with the concerts and the decision to disappear came suddenly.  But how, then, does that jive with a long-planned, orchestrated hoax that involves numerology, intentional symbolism, specific dates, etc. etc.?

There's the candid moments with Michael, where he just seems like the great artistic genius putting together a hell of a stage show - not a movie as part of his planned hoax.  But then there's the admission that old demos were used in parts of the film.  Which parts, I wonder, because how would Michael be able to lip-sync so perfectly without knowing the plan?

See what I mean?  These things are going back and forth like ping pong balls in my head.

I believed Michael died June 25, 2009, and it messed me up.  I can't remember crying so hard over the loss of anybody since my mom died when I was 9. Then,  I was so elated when I saw evidence he's still alive.  The world seemed a brighter place again.  Right now, it feels like I'm losing him all over again, with a repeat of all the crying.  My faith usually doesn't get shaken so easily but, as I've said, I'm having an emotional weekend.

I don't know if I'm just hoping and looking for reasons to believe he's still alive because it breaks my heart to think otherwise.  On the other hand, I can't explain why his death hit me so hard in the first place, so I gotta believe there's a reason.  I gotta believe that my heart isn't lying and my head is just getting in the way.  But this weekend, it's been really hard.

I'd like to suggest a forum dedicated to Tom Mesereau.  I admit, he's one of my favorite players in Michael's life, but I think he more than warrants it.  Having just seen this video, I think we might hear more from/about him in the future:
