![]() It's pretty shocking ... but Katherine Jackson may have taken a giant step today in convincing a jury AEG Live was negligent in protecting Michael Jackson just days before his death. AEG Live honcho Randy Phillips had trouble explaining to Katherine's lawyer why he thought MJ "looked really good" in a meeting 5 days before his death when a photograph taken a day before the meeting clearly showed otherwise. The photo shows a smiling Jackson but someone who looked gaunt and pale. On top of that, there is testimony that producer/director Kenny Ortega and others were alarmed over Jackson's health. In the days preceding his death, Jackson had missed rehearsals and was sweating profusely. He also seemed out of it. As for how Phillips reconciled his statement with other evidence, he said, "I was confused as anybody." Here's the deal ... This case was AEG's to lose. AEG could have made it simple and just said they assumed MJ was being properly cared for by the doctor MJ handpicked. But AEG has gotten a little too cute, painting a picture that the jury may not be buying. Short story ... Propofol aside, if the jury believes AEG unreasonably pushed MJ like a circus animal, they could be in beaucoup trouble. You are not allowed to view links.

County Superior Court judge approved the singer's petition for the name change, which the 58-year-old filed back in November. TMZ broke the story ... the man formerly known as "Jermaine Jackson" had said he wanted to make the change for "artistic reasons" ... whatever that means. Jermaine was not present during the hearing ... because he's off in Europe performing with his brothers ... the Jacksons.

The FDA has issued a notification to more than 350 medical practices across the U.S. -- claiming they may have received unapproved meds, including Botox, from a foreign supplier -- and one of the docs on the giant list is none other than Arnie. The suppliers in question are owned and operated by a company called Canada Drugs, though it's unclear where the drugs are manufactured. According to the FDA, "These medications may be counterfeit, contaminated, improperly stored and transported, ineffective, and/or unsafe." The notice continues, "Medical practices that purchase and administer illegal and unapproved medications from foreign sources are placing patients at risk." But then again, Danger is Arnie's middle name ...

Murray -- who was found guilty of killing Michael Jackson -- has been in jail since he was convicted 13 months ago. The Doc claims in the docs that he's not a flight risk ... partly because he has a small child who lives in L.A. Murray also says he doesn't pose a danger to the community, and believes he was wrongly convicted. Dr. Murray has tried this before and was shut down, but he's entitled to make his case for freedom once again.

La Toya was out in Beverly Hills Sunday night when we asked her all about her two pups -- named Prince and Paris ... after La Toya's famous niece and nephew. And that's when she dropped the bombshell -- telling our camera guy, her furry friends ONLY drink that ridiculously expensive Fiji-brand artesian water in those clear plastic bottles. IT'S JUST NOT TRUE ... this according to sources close to Wahlberg. A new book, entitled "Untouchable," recounts the tale of MJ and MW both jockeying for a Sony private jet. Sony eventually let MJ have it, claims the book. But sources close to Wahlberg tell TMZ the whole thing is a work of fiction. We're told Mark had no need for a plane from Sony to fly back to Los Angeles because he had his own. We knew it was too good to be true.

According to a new book called "Untouchable" by Randall Sullivan ... Michael, his kids and several relatives hightailed it to White Plains, NY a few days after the Twin Towers were hit in order to catch a private plane back to L.A. But according to Sullivan, when M.J. arrived he was confronted by Mark Wahlberg and HIS entourage ... who were also waiting to use Sony's sweet ride. Sullivan says the duo exchanged verbal blows over who got the plane ... until Sony honchos sent word down that M.J. (as the bigger celeb) was the victor. Sullivan says Jackson eventually changed his mind at the last minute and wanted to get to L.A. by bus ... so his entourage flew without him. The book claims Jackson then changed his mind again and sent his mother and some relatives on the bus -- and Sony was forced to send a second plane. The moral of the story is to work for Sony ... they had TWO planes!!!

Jermaine filed a petition for a change of name with L.A. County Superior Court yesterday asking for the change in nomenclature. In the docs, Jermaine says he wants to make the change for "artistic reasons" ... but he does not give any further details about the move. The request has NOT yet been approved by a judge -- but a hearing has been scheduled. Barring any crazy legal situations, Jermaine will be required to have his name change announced publicly several times in the next couple of months before it can be made official. A public announcement consists of having the name printed in a local publication ... just like Ron Artest had to do when he changed his name to Metta World Peace. We reached out to Jermaine ... so far, no response.

The producer -- named Michael Jonzun -- filed the lawsuit in Massachusetts federal court, claiming he helped remake Paul and MJ's 1983 song "I Never Heard" ... into what eventually became MJ's 2009 song "This Is It." According to the lawsuit, Jonzun owns one-third of "This Is It" but he never got paid his share of the song's proceeds -- so he's suing. Paul Anka tells TMZ, he has never even heard the name Michael Jonzun before today -- and any claims Jonzun owns a portion of "This Is It" are "BS."

Register or Login10/18/2012 1:30 PM PDT BY TMZ STAFF ![]() Joe Jackson's gun is 100% legit -- TMZ has learned, Michael Jackson's dad is fully-licensed to carry a concealed weapon in the State of Nevada ... this according to a rep for the Las Vegas Metro Police. The rep tells TMZ, Joe was issued a CCW permit in 2010 by the LVMPD -- allowing him to carry a concealed handgun on his person anywhere in Nevada. The permit expires in 2015. As we reported, Joe showed off the concealed weapon at a recent event in Vegas, and claimed he doesn't leave home without it. FYI -- Nevada's what they call an "open carry" state -- meaning anyone (over 21) can literally walk down the street with a handgun strapped to his or her body, as long as it's exposed. With Joe's permit, he's allowed to keep it inside his jacket. Bottom line ... don't mess with Joe.

AEG announced the move last night ... claiming the company has been contemplating the decision for months and it has nothing to do with the discovery of new emails that show AEG had doubts about MJ's health around the time the company applied for the insurance policy. FYI -- the insurance company, Lloyds of London, had sued both AEG and Michael Jackson LLC in the wake of MJ's death to cancel out the policy. L.O.L. has claimed AEG and MJ were not forthright about the singer's drug addiction and failing health at the time they applied for the policy. Now, a rep for Lloyds tells CNN ... "In exchange for AEG withdrawing its insurance claim, underwriters agreed to dismiss AEG from the case and to waive any costs recoverable from AEG." Lloyds says it's NOT dropping the case against Michael Jackson LLC -- explaining they will press on seeking "rescission of the policy due to nondisclosures of Michael Jackson's prior drug use."

Prince, Paris and Blanket were spotted in Gary, IN yesterday ... along with their co-guardian Katherine Jackson and their aunt La Toya. TJ Jackson -- the OTHER co-guardian -- also made the trip. ![]() Michael will be honored at the annual "Goin Back to Indiana" celebration in Gary ... which kicks off tonight with a candlelight vigil in front of MJ's childhood home. The kids are also expected to throw out the first pitch at a Gary SouthShore RailCats baseball game this week. Michael died on June 25, 2009. He was 50.

D'Errico just released some photos ... in which the actress appears to be sporting multiple cuts and bruises around her mouth and cheek ... and a laceration on her leg. It's unclear how Donna suffered the injuries. Donna had been planning the trip to Mount Ararat for years ... claiming she's wanted to go hunting for the ark ever since she was a little girl. Register or LoginDespite having her face busted up this weekend in Turkey ... former "Baywatch" hottie Donna D'Errico is determined to suffer through the pain and continue her hunt for Noah's Ark, TMZ has learned. If you recall ... Donna was badly injured this weekend near Mount Ararat in Turkey while searching for the Biblical vessel ... sporting cuts and bruises all over her face, arms and legs. Sources close to Donna tell us ... the actress sustained her injuries during a "major fall" while hiking. Despite the setback, we're told the actress still wants to finish out the final two days of the journey -- before flying back to the states. The reason she's willing to power through it ... we're told a trip like this takes extensive planning, research and permit approvals ... and Donna doesn't want all that hard work to go to waste by leaving early. Not only that ... we're told Donna will be going back AGAIN next month to continue the search.
